Please read these Terms of Use ("Terms") carefully before using the BellCount mobile application and any related services (the "Service"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and BellCount ("Company," "we," or "us"). You must be at least the minimum age required by applicable law to use the Service. By using the Service, you represent that you meet this age requirement.

2. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Service for your personal, non-commercial purposes on devices you own or control.

You may not:

  • Copy, modify, or distribute the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for commercial purposes without our written consent
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service in violation of any applicable laws

3. Subscriptions and Payments

Some features of the Service are available through optional paid subscriptions. Subscription purchases, renewals, cancellations and refunds are governed by Apple App Store policies and BellCount's Subscription Terms. Subscription pricing, included features and availability may change over time and are displayed within the App Store and the application.

4. Health and Safety Disclaimer

BellCount is a fitness tracking tool and is not a medical device. The Service is not intended to provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any exercise program. By using the Service, you acknowledge that:

  • Physical exercise carries inherent risks of injury
  • You are responsible for exercising within your own physical limitations
  • BellCount is not liable for any injuries sustained during use of the Service

BellCount provides exercise tracking and repetition counting assistance, but users remain responsible for verifying workout performance, exercise execution and training safety. Heart rate information, workout metrics and performance data provided by BellCount are for informational purposes only and should not be relied upon for medical decisions.

5. User Content

Workout videos, session records and exported content remain under the user's ownership and control. BellCount does not publicly display or distribute user-generated content.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of BellCount and its licensors. Our trademarks, logos, and service marks may not be used without our prior written permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELLCOUNT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain and applicable European Union legislation. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of Spain, unless otherwise required by applicable consumer protection laws.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms. Upon termination, your right to use the Service will immediately cease.
